"For the Manitoba program, you just say this is what I want to do, here's my plan, we give you permanent residency, the person gets off the plane and they can essentially do whatever they want unless they lied about something in the process," says Pagtakhan, who specializes in helping immigrants settle in Manitoba. "Are these people just using this as a passport to move to Vancouver?" No one knows for sure because the province says it doesn't track where the business nominee applicants end up once they arrive here. On average, 259 immigrant applicants and their families were accepted into the business nominee program per year from 2008 09 to 2012 13, according to provincial records. Of those, an average of 81 did not get their deposits back. In 2012 13, the number of applicants who did not get their deposits back soared to 197, well over twice the five year average. The province says that's due to an increase in the number of applicants to the program from 2009 to 2011. However, the number of immigrants who entered into a deposit agreement with the province was less than double the average during those years. Pagtakhan says applicants who failed to invest the minimum $150,000 into a Manitoba business as required and didn't get their deposits back either couldn't make a go of it here or had no intention of staying in Manitoba in the first place. The reality is, immigrant investors may be choosing Manitoba as an easy entry point into Canada because of the province's relatively lax and inexpensive business nominee program, which is less stringent than in other provinces like British Columbia, Pagtakhan says. The problem with the loophole in the system is it wastes scarce nominee spots, which are allocated to each province by the federal government, says Pagtakhan. Those spots could be used to help bring skilled labour to Manitoba which business leaders consistently say they're short of through the province's skilled worker nominee program. "We have a finite number of nomination certificates that we can use to bring in people to settle in Manitoba," said Pagtakhan. "If we're burning those 200 spots to people who are buying property in Vancouver, that's the real negative for Manitoba." In provinces like British Columbia, applicants aren't eligible for permanent residency simply by entering the program like they are in Manitoba, Pagtakhan said. In that province, applicants have to establish a successful business with a higher minimum investment and job quota than in Manitoba before the province will vouch for their permanent residency status with the federal government.
