A 24 year old South Lyon man has filed a lawsuit against Nike, Inc. claiming faulty sneakers contributed to a knee injury sustained while playing basketball at a Salem Township church gymnasium. Brett Gaudreau filed the suit in the Washtenaw County Trial Court July 18, records show. The suit says that Gaudreau received a pair of NIKE Shox Deliver shoes as a gift in Decemeber 2011. On April 8, 2012, Gaudreau was wearing the shoes while playing in a pick up basketball game at Salem Bible Church, said his attorney, Mark F. Miller of Mount Clemens. While playing, of the columns supporting the heel of the left shoe detached from the insole and caused Gaudreau knee to give out, which tore the anterior cruciate ligament, meniscus and cartilage, according to the lawsuit. suffered a pretty bad injury, Miller said. Gaudreau played high school sports and was in good physical shape at the time of the injury, which required reconstructive surgery and kept Gaudreau from working his construction job, his attorney said. The suit lists three counts of negligence. raised a number of allegations in the complaint about the design and manufacture of the shoe, Miller said. The suit claims the shoes were not safe and were perhaps not properly tested or inspected. In addition to the knee injury, Gaudreau suffered permanent scarring, humiliation and embarrassment. The suit seeks damages in excess of $25,000, the minimum amount needed for the case to be heard in circuit court. Nike representatives did not return phone calls. There were no court dates yet scheduled. Dannel P. Malloy's "Plan B'' budget cuts are approved. The Donald T. Bergin Correctional Institution in Storrs would be the prison to close, and the inmates would be sent to other prisons around the state, said Michael P. Lawlor, Malloy's chief budget adviser on prison and criminal justice issues. The measure is a cost cutting move that is made possible because the state's prison population has fallen to its lowest level in 10 years. "It's one of the cheaper to run prisons,'' Lawlor said Wednesday. "There are no cells in there. Half is like a college dormitory with big, open rooms and bunk beds. It's a minimum security prison.'' Bergin is known as a Level 2 facility on a scale that ranges up to 5 for the maximum security, "supermax'' prison in Somers that houses death row inmates and the state's most violent criminals. By contrast, the prisoners at Bergin are often those convicted of multiple drunken driving offenses and those nearing the end of their sentences. The prison closing is part of the "Plan B'' budget that is necessary because Malloy and the state employee unions have not agreed on $2 billion in concessions and savings over two years. Matt O'Connor, a spokesman for the unions, said Wednesday night that the two sides had been talking throughout the day and into the night in a continuing effort to reach a deal. "We're anticipating a hopeful outcome at some point,'' O'Connor said. "If we're still talking, there's reason to be hopeful.'' If the "Plan B'' budget cuts are enacted by the legislature, Bergin would be the third prison to close in about 18 months. The state has already closed Webster Correctional Institution in Cheshire, as ordered by then Gov. M. Jodi Rell to save the state $3.4 million yearly. Malloy has ordered the closure of Gates prison in Niantic on June 1. Gates, which holds about 700 criminals, is a Level 2, minimum security faculty like Bergin. With three prisons closed, the state would have 15 correctional facilities. Bergin had 931 inmates on Jan. 1 and 218 state employees to run the facility. The prison is on the site of the former Mansfield Training School, which was ordered closed in 1993 by then Gov. Lowell P. Weicker, Jr. Formerly known as the Northeast Correctional Institution, the prison held 500 criminals in 1999 and then 650 inmates in 2001 following an expansion. The state's overall inmate population has fallen to about 17,500, which is the lowest in 10 years. It is also far lower than the all time peak of 19,894 in February 2008, which occurred after the triple slayings and arson at the home of the Petit family in Cheshire. Jennifer Hawke Petit and her two daughters were killed, and Steven Hayes has been convicted on multiple counts in their deaths. A second defendant, Joshua Komisarjevsky, is awaiting trial later this year. The prison population exploded by about 1,200 after Rell froze the parole system following the triple homicide in Cheshire and large numbers of inmates were not allowed out of the prisons. Lawlor says that closing prisons is part of a national trend as crime has decreased and the number of inmates has decreased.
