During the three hour snorkeling trip, we stopped frequently to don masks and fins and hit the clear waters. At the Hollywood Bowl snorkeling stop, I spotted blue tang, parrotfish, yellowtail snappers, several sergeant majors and one intimidating barracuda. The second stop, called Little Elvis, was described by instructor Ida Stjernstrom as the "king of all reefs, because it would take a week to snorkel the length of the reef." After a brief orientation on how to pilot the SUB, everyone gets on one of these things and descends 20 feet, where they can pilot around the reef at a leisurely 2 knots (1 mph) to look at fish. The suit's success or failure would depend on the role that the museum played in the marketing of the trip. In personal injury cases, plaintiffs' attorneys need to sue everybody involved in the sales process, regardless of whether the attorneys think that a particular defendant might really be liable. If it later turns out the party at fault was not sued, the statute of limitations might already have run out, leaving the attorney open to a malpractice claim. In a suit, the plaintiff would probably make three allegations: The first one would be that the museum was negligent in endorsing the trip that you arranged because it failed to investigate the suppliers or your agency. This claim has a superficial plausibility, but it would probably not succeed. Although some courts have found that a nonprofit co sponsor of a tour has a duty to conduct an investigation of travel suppliers, the modern trend of such cases is not to impose such a duty on sponsors. The plaintiff's second claim might well be that, aside from a duty to investigate, the museum had a duty to supervise the operation of the trip to help prevent injuries. In most cases, these claims have also failed, especially if the museum can show that it was not in a position to control operations and could not be expected to do so. The plaintiff's third claim would probably be that the museum acted as your agency's partner or joint venturer by jointly making decisions, jointly operating the trip and sharing the profits or losses. If the court found that the museum did none of these things but instead merely offered the trip in return for a percentage of the gross sales, as is usual in such relationships, then the museum would probably not be seen as your partner or joint venturer. Even if the museum prevails, defense costs will be tens or even hundreds of thousands of dollars. Therefore, it pays to take some steps to prevent such suits in the first place or to minimize defense costs in case of a lawsuit. Send a memo to the museum explaining why you chose the particular suppliers and showing your successful track record with them, or at least their good reputation in the industry. If you have no real idea who the suppliers are, then you probably don't want to use them. Add the museum's name to your participant's agreement, so that your disclaimer and limitations of liability apply to the museum as well as to your agency. (There is plenty of info on THRs all over the web.) I been in the Army for 20 years and I just ran a half marathon in the Iraqi Desert this past May. What I found that most people do is that they push themselves TOO hard. Then they get discouraged.If you want to improve, get a heart rate monitor, and run on a treadmill where you can get a constant pace (this is just until you are more used to running at a pace.) Then, only run to get to 80% THR. If you start exceeding it (and you will at first,) SLOW DOWN (but don walk.) I personally swear by this method and it has served me very well.
